'Ripae fluminis' e 'litora maris' nella prospettiva gaiana e in quella giustinianea: riflessioni sparse

The report aims to highlight the conception of the river banks, the sea and its seashore proposed by the second century jurist Gaius, starting from the analysis of a fragment of the Res cottidianae contained in D.1.8.5 pr. In this fragment the Antonine jurist seems, among the others, to connect the legal regime of the sea in the context of the ius gentium. The text, which is not always consistent, will be analyzed in parallel with a passage of Justinian's Institutes (I. 2.1 pr. -5): the comparative analysis will clarify the perspective of Gaius about ripae fluminis and sea, framing it in the debate of the age of the Antonine jurist.

El texto pretende resaltar el concepto propuesto en el siglo II d.C. por el jurista Gayo de las orillas, del mar y de su orilla, a través del análisis de un fragmento de la Res cottidianae contenida en D.1.8.5 pr. En este fragmento, el jurista antonino parece situar el régimen jurídico del mar en el contexto del ius gentium. El texto, que no siempre es coherente, será analizado en paralelo con un testimonio de las Instituciones de Justiniano (I. 2.1 pr. -5): el análisis comparativo permitirá aclarar la perspectiva de Gayo sobre las ripae fluminis y el mar, enmarcándola en el debate sobre la edad del jurista Antonino.
